• S&E Attorney Part of Training Delegation for Lawyers and Judges in Democratic Republic of Congo

    Recently David J. Schubert travelled to Bukavu, Democratic Republic of Congo as a member of a 4 attorney delegation sponsored by African Leadership and Reconciliation Ministies and participated in a 3 day seminar on peacebuilding, conflict resolution and servant leadership. Approximately 40 Congolese lawyers, judges and journalists attended the program.

    Blake Evans and Stephen Burnett addressed the Legal and Risk Management Divisions of the City of Dallas at their annual CLE program. The presentation concerned maximization of risk transfer vehicles, including indemnity and additional insured coverage.

  • S&E Attorney Moderates Dallas Bar Association Panel Discussion

    Blake Evans moderated a panel discussion hosted by the Tort and Insurance Practice Section of the Dallas Bar Association. The topic of the discussion was the Texas Supreme Court's recent opinion in Ewing v. Amerisure and its implications for construction defect insurance coverage.

  • S&E Gets Summary Judgment Win Under EPL Policy

    Blake Evans and Stephen Burnett obtained a critical summary judgment on behalf of their client in a Fort Worth state court declaratory judgment lawsuit concerning coverage for an underlying employment claim under an EPL policy. The summary judgment concerned the core issue of whether alleged misrepresentations about an employee discount home purchase policy were covered "employment-related" misrepresentations under the EPL policy.

  • S&E Obtains "Death Penalty" Sanction on behalf of Client

    Schubert & Evans (Blake Evans and Stephen Burnett) recently obtained a "death penalty" sanction against a defendant in a Florida state court coverage suit. The trial court found that multiple violations of previous discovery orders (two of which Schubert & Evans upheld on appeal) warranted the imposition of sanctions that included striking the opposing party's pleadings and entry of a default judgment on liability.

    David Schubert was a presenter at the State Bar of Texas Advanced Insurance Law CLE seminar in Dallas. He presented a paper on the latest developments regarding the "Eight-Corners" rule and the duty to defend under liability policies entitled "The Current 'Complaint Allegation' a/k/a 'Eight-Corners' Rule In Texas."

    David Schubert and Stephen Burnett presented a continuing education program on Texas law and claims-handling to the regional office of one of the nation's largest insurers of trucking companies.

  • S&E Attorney Addresses City of Dallas

    Blake Evans presented a seminar entitled "Shifting Loss: Significant Issues Related to Contractual Indemnity, Additional Insureds and Certificates of Insurance" to legal and risk management personnel with the City of Dallas. Topics included a variety of risk transfer vehicles, including contractual indemnity provisions and analysis of additional insured issues.

  • S&E Presents In-House Continuing Education Program

    David Schubert and Blake Evans presented an in-house continuing education program to approximately 100 claims professionals at the home office of a major property/casualty insurer. The program provided a comprehensive update on Texas law relating to coverage and extracontractual claims, including duty to defend, additional insured coverage, contractual indemnity, first-party "bad faith," the Stowers doctrine, and Insurance Code liability under Chapters 541 and 542. It also included an up-to-the-minute summary of the bills currently under consideration by the Texas Legislature.
